i wanted to know if it is legal for the landlord to tow a car that is unisnspected if it's parked in our designated parking space. we don't have a lease agreement with them. we live in lewiston, maine.

NO that would be Illegal.....and the landlord cannot tow a car with and expired inspection sticker, so he must refund the towing charge....or sue them in small claims court.

Now if it had EXPIRED license plates, or NO license plates or was not drivable, then YES he can.

In answer to 'higgins':
Your post says that the car was parked in "your designated parking space". I assume that this is a multi-family location (apartment or duplex with assigned parking). If correct, the parking space is not yours and the owner can authorize the vehicle tow.

I must ask though.... since your post says that you do NOT have a lease, how is this your "designated parking space"??

Further, I assume that there are some posted or issued 'rules' that include specific requirements for any vehicles parked on premises. This could include 'must be in working condition", "must be currently registered and titled", "holding current and valid safety inspection", etc. and could authorize the towing of any vehicle that doesn't meet those requirements. If true, you have even less ground to stand on when filing your complaint.

we have been living here for 1 1/2 yrs. after living here for about 4 mos. the new owners took over. they never asked us to sign a leas agreement. they just recently put a sign on the building door (yes, this is a building complex. 8 buildings, 8 apts. in each building.) that stated that due to congested parking that if the car was unregistered and uninspected it would be towed at owners expense. do we have any say in the matter. in response to the designated parking spot, the spot has our apt.# painted on.

They gave you notice and you ignored it.....

not much you can do......if it had only said unregistered, thats different.

or if the notice was dated say Oct 15th and your car was towed on Oct 14th.

Other scenerios: you all were out of town and never recieved notice and when you came back the car was towed.

Or you had it inspected and it Failed, and you had xx days to fix it and it was still a Valid Failed sticker.

(remember it said inspected, NOT a vaild inspection, if the state gives you xx days to drive and get a Failed inspection fixed the complex must also)
