 i will be filing for bankruptcy ina few days. my wages have been garnished over the last few months for medical bills at a local hospital. a co-worker, who went through bankruptcy, informed me that after i file, they will repay the money that was garnished. the total was $1000.00. is it true that i can get those wages back or do they keep it?

thank you,

dave

It is possible to recover the amount that was garnished in the 90-day period prior to your filing. Here is a URL to a document (pdf) that I found while looking up the same thing for another poster:

recover garnishments

From reading this and another court decision (lots of legalese to plow thru), it looks like you and your lawyer need to list the wages correctly to recover the amounts.

I hope this helps.
