I have a question, if anyone can help. The fence around my home is falling apart. My next door neighbor is willing to split the cost of a new fence along the side of our homes. Our neighbor behind us says he will pay for half of the fence. The problem is, his next door neighbor put up a new fence and our neighbor said he would pay for half of that fence. So far, this neighbor hasn't paid a dime towards the fence, and this was six months ago.
It's obvious that our neighbor behind me is jerking us around. I am wondering if I paid for the entire fence, is it possible that I could put a lean or a mechanics lean against my neighbor behind us for non payment? Or do I need to get a statement in writing that he agrees to pay for half the fence.

Any ideas would be appreciated if you can help.

In my state, your neighbors have no legal obligation to pay any monies toward the purchase of your fence. Nor are you obligated to give them any options as to style, color, material, etc. Any agreement with them would be a gentleman's agreement and not admissible in the court of law.
