Hello, I live in California. I got a DUI a few years back and have already completed all the classes and payments required and currently have no restrictions on my license. It is, however, still on my record. I have an interview for a new job tomorrow. My question is whether or not I have to mention that I have a DUI on my record.

The job is with a small company. I have already sent my resume in and been asked to come in for an interview. The job is a tech related job and requires that I drive a company car to customer's homes. I'm not sure if I only have to report a DUI to a current employer or to a new employer or if it only matters that I have no restrictions on my license.

I don't believe I will be filling out an application that specifically asks if I have any crimes on my record. This is a small company.

The interview is tomorrow, so fast responses would be appreciated.

If they ask if you have been convicted, the answer is yes.

If you say no, you are taking a risk on it showing up on your background check.

While all background checks are not the same, a DUI has a pretty decent likelihood of appearing... especially if you are going to be driving one of their vehicles.

I have hired people with records... even felons. I have never hired anyone that lied to me on their interview.

Especially in a retail environment.

if they ask, be honest. let them know you also completed all fine, classes and probation.

look into getting an expungement.

In CA employers may ask about convictions. If you lie, and they discover it - even years from now - you can be terminated.

You need to determine exactly what shows up on your record. If it's a conviction, and they ask you if you have ever been convicted of a crime, then you have to say yes. If you got court supervision, and they ask you if you have ever been convicted of a crime, then you can answer no.
