 What is the name of your state? Virginia

I have a friend who is going thru a really rough time right now. This is the only place I knew to turn to try to find any help at all. My friend was 2 payments behind on her van. They came and repoed it yesterday. The place where she bought the van was a buy here, pay here place. She did call this man and talk to him about getting the van back. He told her that the ONLY WAY this van can be returned is if she payed the WHOLE BALANCE of the loan which is $2,000.00. Can he not return it if she pays the late payments and the late fees? (her sister is willing to catch her up). Does she have any recourse about this vechile?

(Just letting you guys know..that she is not trying to get out of this loan or anything..she usually pays her bills on time... Her daughter took off last month leaving her 3 grandchildren to raise on $400.00 a month and she is having a really hard time.)

Any advice or reference to laws pertaining to this subject would be a great help.

Thank you

Sorry, but they do not have to give it back to her just for the late payments now that it has been repo'd. She should, however, be given the chance to REDEEM it before its sold on the auction block. That means she pays them the balance up front - which is what she's been told. If she cannot do that, then the van will be sold and she will get a bill for the deficiency plus fees :(
