What is the name of your state?California

My sister had her car repo'd last week...She didn't tell us she was having money problems, but that's another thread for another time (divorce). Anyhow:

When they repo'd her car, she was 3 months behind ($467.00 /mo). She cannot afford to get the car back, she still owes $16,000 on the vehicle..She lost her job 9 months ago and is unable to pay her debts...Another thing she failed to mention to the family..

I know that the bank will probably sell the vehicle and do whatever they can to recoop their loss. Questions:

1. If they sell the car, for less than what is owed, is she responsible for the balance??

2. What methods does the agency try to collect this debt.

3. Will her wages be garnished (once she's employed again)??

Any insight would be appreciated...I want to help my sister but wanted more information on what to look forward to, before jumping in..

MY RESPONSE: They send out bloodhounds, hunters and trackers.


3. Will her wages be garnished (once she's employed again)??

MY RESPONSE: She can bet on it. However, that only happens after she's sued and loses (which she will).

Thank you IAAL...One quick question...Her only income at this point is child support which is being sent by 2 X's to DCSS (she's receiving food stamps and medicare for her kids), as well....Will her CS support be garnished at all?

Oh, wonderful. Another welfare woman who wanted to prove she could have children. Tell your sister, thanks a lot for all of us taxpayers.

Let me guess - - she wasn't married to either of the men, right?

She was married to one for 10 years, 2 kids....He left, she's verbally abusive, met some guy, kid #3, lived with him 2 years, until he got tired of her crap...And yes, she's a loser....living off the system...I've tried to help her in the past, but now it's time for tough love....

Anyhow, do you have an answer on my 3rd question.

P.S. I'm well-educated (Bachelor's in Computer Science) and take care of my own affairs....My mom won't admit it, but I suspect I'm adopted...I'm nothing like my sister!!

Unfortunately, or fortunately, depending on which side of the fence you're standing (either the taxpayer side, or the child side), her child support is untouchable in a garnishment.

Thank you for being a worthwhile member of society, and not a skank like your sister.

Thanks for the info.....funny thing is...the bio-dad to the first 2 is a worthwile member of society as well, wants custody of the kids...but because she's the mother and blah, blah, blah.....she get's custody...so sad..They would be better off with dad, but trying to convincing the court system is pointless. As long as she's not homeless, or harming the kids...nothing he can do....

Yeah, some kids get all the breaks in life . . .

There's nothing like having Kellogg's Corn Flakes for dinner, and Kraft Macaroni and Cheese for breakfast.
