After filing Unlawful Detainer, tenant responds with Stay of Execution. Monthly rental value is with the CLERK of the County Trial Courts. Do I need to fill out a REQUEST FOR ENTRY OF DEFAULT? If so, would it be CLERK'S JUDGMENT or COURT JUDGMENT?

My response:

If there is a "Stay" in effect, you can do nothing.

We need to know the situation between you and the tenant - - e.g., is there a Bankruptcy? Is the tenant holding back partial rent for repairs? Is the tenant failing to pay? Is there a claimed "hardship" in his motion papers?

What's the reason, and what's going on?
