Request Injunction Of School Board Vote

Dear Attorneys,


I live in a township where the school board recently voted to terminate their International Baccalaureate program, one which costs less that one percent of the school budget but is used by over 30% of its students. The decision was based more on the personal beliefs of several of the board members rather than on financial issues. In fact, the school board wants to keep the money and apply it to Advanced Placement funding, so there is not a redirection of these monies to offset the budget.


The board had elected to evaluate the program prior to any vote; however, there were almost a dozen procedural and evaluation gaffes made by the board that ensured the outcome the board's majority desired. There were several violations of due process, setting unobtainable criteria for staff votes of 70%, which is higher than any majority required in the government and also many instances of ignoring evidence that supported the program. There is a similar case in Upper St. Clair, PA that this case can be modeled after. We have an attorney who offered time to identify these issues but she has exhausted her pro bono allotment at her firm _ as she is working on another case. She is willing to transfer information or partner with another firm. The finances are not great, but several thousand would be available to offset some expenses.


This case is a very high profile one, which has made quite a bit of New Jersey new, especially in South Jersey, as well as hitting national press. This would garnish just as much press as the Upper St. Clair case did.


I was wondering if there would be any firms out there who would want to participate in an injunction to prevent the dismantling of this program?


Any and all help would be greatly appreciated.
