Request to delay depostion

Hi again,

I've just received a Notice of Taking Oral Depositon....from my ex's lawyer. All of this goes along with his Petition to Modify Custody, which I figured wasn't going anywhere until after his criminal trial on the five felony counts of child/sexual abuse. Now, this comes and it's set for July 7.

My questions: Does this notice make attendance mandatory?
Is there a way I can have it delayed, citing either the need for the criminal trial to be completed, or the need for me to secure a lawyer long enough in advance to prepare?


His nerve just floors me.....
