I broke a lease with four months left on the agreement. Even though I gave a 30 day written notice, I was still charged the full amount of the lease. I have now found out the landlords used my apartment for an office while their office was remodelled. My question is can they charge me for the full amount of the lease when they used the apartment as an office instead of trying to rent it back out? Can I get my money back on those months? Also, my copy of the lease agreement is signed by me, but the landlords only typed in their names, not signed or initialled next to the typed name. Is this still a binding contract? Again, I live in the state of Indiana.

L can't use the apt as an office AND charge you rent for the same time. Essentially, L re-rented the apt to itself, & L can only collect rent from one person at a time! Sue L in small claims for a full refund of rent. I don't think L typing its name instead of signing will have any legal effect.

Did L send you a statement of damages & deductions frm the deposit within 45 days of you leaving & giving L your forwarding address? If not, you are entitled to recover the entire deposit. [IC 32-7-5-12] Add the security deposit claim to your suit. What will happen is the court will order L to give you the deposit, but will then order you to pay L damages + rent until L took over the apt as its office.
