Hello, I am a former property insurance claims adjuster and current part-time law student in the Minneapolis area, with a question on claims settlement for damaged siding on residential property.
To my understanding and experience, on a homeowners insurance policy under Minnesota law (and parts of St. Louis, MO, also I think?), if any part of the siding on your home is damaged by a covered peril (wind, hail, etc), then the insurer owes to "wrap" all elevations (north, south, east, west) on your entire home, as opposed to just owing for "direct physical damage" of the actual section of siding that was damaged.
I believe this is based on an insurer's obligation to produce a "reasonable match" across all elevations (N,S,E,W) on the structure (home, detached garage, backyard shed, whatever).
I believe this was set forth under Hennepin County District Court case number 27-CV-99-3907.
My big question is this -- is there any similar provision under Wisconsin law? That is, if you are a homeowner in Wisconsin and sustain damage to your siding, can you insist that the insurer pay to "wrap" the entire structure, or does the insurer only owe for "direct physical damage" on the siding?
