I am part of a private neighborhood assoc 1/28 owner of a park. I have 2 roommates living with me in a 3 bedroom house. The assoc. sent me a certified letter stating "If the boarders, renters, tenants, friends, guests, etc. are still residing in your house thirty days from the date of this letter, I will instruct my attorney to commence legal proceedings to enforce the single family requirement by court order." I got a copy of their covenants and the only thing it says under the Use of Land section is "The lots shall be used for private residence purposes only... " and "...each dwelling house being detached and being designed for occupancy by a single family in its entirety."

My question is does the assoc have the right to enforce who lives in my house. The above statement is the only docuementation on the subject. With no rent being paid.

Thanks for any advice.

Send a certified letter back requesting a copy of the CCR's, By-Laws, House Rules, City/County/State laws etc. that support their position.
