What is the name of your state? CA

I was wondering if there is a way for me to get my residence through my job? I heard there is. My boss would have to file for me or someway claim me to be needed in the job. I haven't talked to him about it, but really i am considering asking him. Does anyone know the process for this? How would he go about this, considering that he agrees to? What would be the first step or the easiest way to do this? Like, would it be inconvinient for the company, my boss or me? What would he have to do? If anyone has done this, or knows what I can do if possible, please let me know . . .. thank you . . . .
 


Yes, there is absolutely a way to get resident status through your job. How complicated the process is depends largely on your qualifications, although the whole process got somewhat easier just recently.

What would be the best qualifications? What would be the first step for this? Say my boss agrees to it, what are the odds or chances for me qualifying? What kind of things would get in the way?

Well, getting a green card through work is a 2-step process. First you need approval from the Department of Labor and then INS processes your case. Department of Labor certification process can be avoided if you are a doctor, a nurse or if you are an outstanding professor/researcher, have an extraordinary ability or you are an international executive/manager. If you are none of this, you have to show to the Department of Labor that there are no Americans who can do your job, this is usually done by advertising your position in a number of sources and then conducting interviews.

Oh okay. Well besides that is there any other restrictions, that might get in the way like, the amount of time i have in the country, the country im from, my record (crminal, even though i dont have one)? when trying to proof that no other american can do my job, how would that work? Whats the best way to show that im more than qualify for that job than anyone else? Does this usually take long? And if all fails to do so, can deportation be the worst outcome?

You did not give your complete information in this post, so you are getting information that is not correct for you.
You Entered Without Ispection many years ago. You should spend your time at an immigrant's legal aid charity (Catholic Charities is one) trying to find a solution. NO OTHER VISA is going to help you at this time; as soon as you leave the US you are barred for 10 years.

If you really want to succeed, stop trying to find a way out of this yourself; it really is very complicated.
