In 1998 my husband and I signed a contract for a lifetime membership to a camping resort. We used the resort once..and were not happy with it. Several calls to the office to resolve the matter (a settlement to pay off the contract and be done with it) got no results. My husband had a back injury and we were unable to pay on the contract further. It was sent to a collections agency in 2002, to whom we paid $50 and then heard nothing more from. In March, I recived two letters from a collections agency, one for the remainder of the contract and one for yearly maintance fees totaling close to $3000.
I filed a complaint with the Attorney Generals office, with settlement offers included, since we had tried several times before this to resolve the matter . In doing so..I found out that other complaints had been filed with that office as well as the BBB to which none had been answered by the company. As well as finding out that land that the resort had been charging memberships for to use was actually public land leased from the state..(They lost this lease 2 years ago due to misuse and safety issues..the area is now fenced off and unacessable from the resort) as well as there being a possiblity of the people we signed the complaint with initally not owning the resort any longer.
After filing the complaint, I was contacted by the company, (they withdrew the account from the collection agency they'd placed it with) who first told me the amount owe would be $5000 but they would settle for $3000 (the amount owed in the letters) but in one lump sum. After I told them I couldn't do that, they lowered it to $1500 but still wanted the money in one lump sum. When told that I couldn't do that either, they threatened to sell my propery ect...(of which I don't own).
*(the Attorney Generals office asked me what I had to loose by not paying these people..I answered that I had nothing since I didn't want the membership any longer..his advice to me was to not worry about it then since they'd had so many complaints brought against them and so forth)*
My questions is..does the SOL of 5 years hold even if I paid the collection agency in 2002?
What are my options in this matter? Can they take me to court? Can I take them to court?
