my wife has a protective order against me,since 2-6-06.my children are included in this order,but i have visitation of my 12 yr. old daughter 5 hrs. a week.on valentine's day i sent my daughter a card thru the mail my wife had me arrested,and i spent three day in jail.i go to court for this on 7-7-06,i have heard in n.c. that you must have 5b violations before being convicted would like to know if this is true
also,since getting the order my wife has been calling me daily i have the phone records.in these calls she is asking for fanicial advise corcerning the home we shared,among other topics,she lets my daughter call medaily severals times a day as well as email and instant message me.what are my options of getting the restraining order over turned or vacated if any. please answer thank you

A restraining order is mean't to keep you at bay or away...you need to follow the order...no contact means NONE
You can find yourself in more trouble...If you had pre-existing visitation order to see your daughter and since then the wife has filed restraining order...then stop all contact with child unless a court of law states otherwise.
You may need to address this issue in court...otherwise you will dig a deeper hole for yourself.
DO NOT communicate via telephone either to mom or child.
The mother of your child may be trying to set you up and use this against you when you both go back to court. But you should keep records of times and dates the mother and child have called you since the restraining order was filed, to show proof mom is violating the order as well.

Mom is NOT violating the order unless the ORDER is AGAINST HER. Unless she has a restraining order against her she cannot violate the order against him. He can violate it by continuing a conversation with anyone who is covered under the restraining order.
