order of protection?

I live in NY. My husband and I are in the process of becoming separated. We are separating because he is an alcoholic and when he drinks he says and does stupid things. We are seven days into the agreed upon thirty days days he has to vacate the home, in accordance with our separation agreement. We have been living in the same home. This weekend he went on a drinking binge and brought a stranger into the home (I was away and not in the home at the time) who ended up stealing property. The person he brought home turned out to be a complete stranger so there is no hope of finding the guy. Two days after the first robbery we were robbed again--presumably by the same person. I want to know if this is grounds for an order of protection so he will have to leave before the thirty days is up? I have since moved out because I no longer feel safe with him and his reckless behaviour. However, I also don't feel comfortable leaving him in the house alone either for fear that all of my belongings will end up missing. Thanks for any help you can give.

My response:

Problem solved. Simple.

Since you've already moved out, you have an obligation and duty to yourself to protect your property. Therefore, move your "stuff" into storage.

Take whatever further action you deem advisable with regard to your marriage; but, if you do the above, you can save yourself a trip to the courthouse.

Good luck.
