my boyfriend is in the process of getting a divorce. he lives with me now but his wife doesn't like it. she says she will get a restraining order to prevent me from seeing him, something about me interfering with her marriage. can she get a restraining order against me for this reason? i live in indiana. thank you for your help.

My response:

She can do this to you - - if you all lived on Mars or Venus.

But, since you live in Indiana, she doesn't know what she's talking about. We all, under the Federal Constitution, have the right to associate with whomever we choose; ergo, she can't restrain her husband from seeing or being with you.

IAAL is correct, as usual. ;-)

She could get a restraining order to keep you away from HER. But she can't get a restraining order to keep you from him.

Fortunately, as IAAL pointed out, in the United States, we adults can associate with whomever we like.
