This has been many years ago now (1994), but a friend of mine was driving my car and I was in the passenger seat. We were both extremely intoxicated. He managed to crash my car into the center median of the freeway. When the state patrol arrived, we were both out of the car. Immediately the police asked who was driving, and my friend denied it, I said bull**** he was driving. Immediately they put both of us in separate cars and did the he said she said scenarios with us. The trooper finally said I'll just charge the both of you and let the courts decide. It must have been thrown out of court because neither one of us got a court date. I refused to take the breathalyzer stating I was not the driver. I managed to get a dui a few years later 1996, which was my 2nd. (But they (dmv) treat it as my 3rd because of the incident in 1994, (i had one in 92 also))

As a result of this I have a drug/alcohol restriction on my drivers license. I tried appealing this years back, and they said that I was out of the 30 day administrative review period. Is there anything I can do, I was out with a group of friends last week, and we had to completely change plans because the nightclub we went to would not let me in since I was restricted.

We both have this episode on our driving record, he even sent a signed notarized letter to the state admitting his guilt, and they still would not change it.

I normally have no sympathy for drunk drivers. I think you need to look at the big picture...........Whats the underlining problem??? You need to seek legal Councel. Based on your history, you are running out of options. And please do us all a favor ...Stay of the roads when you drink. I wish you well. Not advice. For what it's Worth. Patrolman/ J. Buckner
