the mother of my 2 grandchildren :boy age 3 ,girl age 2 is trying to regain custody of children .she gave them to the father (my son ) june 5 2000. he took the matter to court in sept 2000. 1. to prove paternaty.(2.) to get legal custody. the mother wanted to surrerder all rights but court would not allow that ,they ordered her to pay child support(which she has never paid )they did withhold her income tax return.she was given supervised visitation at my house every monday+friday at12:00 to 2:30.she came very few times from sept till last day of oct. then did not see or call about them untill may of 2001 . seven months of no visits no calls then all of a sudden she wants to see them then she fills a petion with the court she wants the children returned to her stating the father drinks and uses drugs. untrue he does drink a beer once in awhile even has a six pack in fridge . he has taken care of these children since she left { kept them in the same home took them on trips they have become very attached to their father and all the family member her mother came for a while but we havent seen her in months. does she stand achance due to the exspence of raising 2 children on his own he cannot afford a lawer .this comes up in court next mounth

If the father has legal custodial rights, and can bury the allegations of alcohol and drug usage......then she needs more than luck to get them back. Make sure your son is willingly ready to give a urinalisys to back his claim......I dont think it will go that far, more than likely the court will standby its first decision unless somehow she can prove to the court that he is an unfit father.

he full sole pernament custody of children she is in contempt of court for non support, she also gave up her other three chlidren one to his grandmother [7 years old] he since has returned home be cause the grand mother could no longer care for him due to medical reasons.the court gave the mother temp custody of him .two months later she gave up a daughter 4 years old.and son 5 years old to dhs. they now are living with their grand mother. 5 children 7rs to 2yrs old three different dads. she remarried last mounth . prior to that we can prove she had 4 relationships ,5 jobs,3 residences in one yrs time. since she gave up chidren . no problem passing drug test .
