Iowa. My friend's divorce was final 2/22/01. The judge awarded him the house and two of three vehicles. When he went to retrieve one vehicle awarded to him by the court from his ex's workplace his ex called cops and said he was violating a court order of protection and he was arrested on the spot and spent the night in jail even though he had the court order for his vehicle in his pocket at the time of arrest.
Last July he filed for, and was awarded, an order of protection against her for domestic violence and she has lived with her brother since. There is not now or ever has been a court order of protection against him.
Three questions please;
1) What can he legally do to get his Jeep back without any more trouble from her or the police?
2) Does he have grounds to sue the police for false arrest?
3) How does he protect himself from this sort of manipulation in the future?

1. Go to the police with the court order and ask them to escort you to pick up the jeep.
2. No, but he could try and press charges against her or push the police to do so.
3. He carrys the order of protection with him at all times as well as the number for the police report for the incident above. Then, if it happens again, he informs of the police report and how it has happened before.
