State:Georgia !Live in a subdividion. Was told by builder that before home was built that retention pond would be removed. Found out days before closing from city building inspector that this was legally not true. Now own house and also own property with retention pond that did not drain properly.Which city knew about. City decided to fix retention pond. Was still not fixed properly for drainage. Was told that neighborhood child got stuck in retention pond 3 weeks ago! Was not told that day! Have not received any legal actions against us. Worried for my own children and others. Do I have any legal action to sue city or county for this danger being on my property? And selling a house near this retention pond?

Hopefully you have some documents to discribe what interactions have taken place in the past. If you do not, then you should, begin at square one, and document all the notifications and conversations that take place from this point on. Begin to build your case, but keep quiet about it. start with the person who sold you the home, then the city, etc. keeping clear records of the times, names, and dates. Once you have some ammunition to present, then you can begin to apply pressure to those who have told you the problem with the retention pond would be taken care of. Safety is a tough issue for any city or county to not pay any attention to. It sounds as if you have already had one close call. Any witnesses? Begin to build your case asap, and don't stop till its over. Get tough! Good luck.
