I share property on a retention pond with 9 other HO's. We have no HO's Assoc in our community, and it has come to light that all of us would be liable if someone were to get hurt, or a child drown in this pond. I cannot get the other HO's to understand the danger, because everyone has the opinion that "No one is going to get hurt", no one has up until now. When th othr HO's allow persons to acces their properrty to fish, it puts my property at risk. How can this be? I can put a sign in my yard, but that does not prevent others from allowing people access, and putting me at risk of a potential lawsuit. I've talked to our towns Senior Planner, and he is the one who says because of our covenants, all of us could be in dnger of a lawsuit should something happen. I want to stop people from fishing there, what do I do? We have no state or town law governing retention ponds, the #2 drowning factor in our state.
