What is the name of your state? KENTUCKY......In our divorce agreement my ex-wife is entitled to a portion of my retirement penion, it also stated that her "new husband" would be the recipent upon her death. Two years ago she filed a QDRO, with my employer, to draw her portion (when I turned 55 yrs of age) and has been drawing her benefit. Since then she has divorced her husband and she has died. Will her ex-husband still receive this benefit from my retirement program or can I re-claim this portion, since it is a part of my retirement package and that she was no longer married or can our Son (who is her only hire) receive this benefit?What is the name of your state?
