I live in Milwaukee, WI. I lived in an apartment for 1yr and lease was up. Moved 12 days early and the landlord reimbursed me for the 12 day rent. The place was left in excellent condition. I received a check from the landlord for part of the security deposit indicating that the deductions were for cleaning of the apartment at a different address. on the bottom of the check he stated return of security deposit for the same incorrect address. I took pictures of the apartment prior to turning over the keys. The amount of deductions is $3.00 less than what he paid me for the 12days. My question is if I cash the check, will that constitute acceptance of the amount and eliminate my chances of winning the small claims case? If so, is there an endorsement I can use to eliminate this issue?

Are there any 'endorsments' (like "Paid in Full") on the check that you received. If not, then there shouldn't be any concern about depositing the check and still being able to protect your options. If they did put an endorsement, I would suggest you send the check back with a letter detailing your objection (and non-acceptance) of the endorsement with a demand for payment.
