Returned item . . . online store says item is missing in box

Hi,

I purchased a product online. I received the product but it was the wrong item. I was told to take pictures to prove that it was the wrong item, which I did. Once it was proved that it was the wrong product the online store sent me a shipping label online. I packed the item myself and sent it back through UPS by dropping it off at the UPS store. Now the online store emailed me back saying the box was empty. I know the product is in there since I packed it myself. So now they will not give me my refund. I filed a dispute through american express, but I am wondering what are my rights in this type of case. I have no reason to keep the product since it will not work for me. Also I checked the tracking number and they recieved the so called empty box.

Doesn't UPS offer insurance? If so file a claim with them. I don't use them, too many problems, but I seem to remember having to go through the claims process a few times.

Things to consider:

1. UPS offers about $100 free insurance even if you didn't sign up for more.
2. Check the weight of the shipped package vs. the received package-- you should see missing weight as proof it was sent.

Thanks, I will go to the UPS store and ask them about the weights. But what if it is the same weight and the store is just lying about the box being empty or someone at the stores receiving department messed up and took it out of the box and misplaced it?

I will check up on the insurance also. I called american express and filed a claim through them to cancel payment. They said they would investigate.

I think the store should be responsible and refund my money and take care of the insurance themselves. They are the ones who ordered the shipping label for the return.

I packed the box myself and I know I packed the product in the box. I went to bizrate.com and have noticed that this store I bought from has terrible customer support. I guess a lesson learned to research more before I buy online.
