Returning deposit

i rent a single family home in utah. my tenant has been in the home since june 2000. he originally signed a year lease. when it came time to renew the lease he would not sign. he stated he was looking for a home to buy and would not sign a new lease with me. after about 8 months of asking for a new lease he gave 30 days notice to move.

my question is: since he wouldn't sign a new lease is he still entitled to receive his initial security/pet deposit back? (minus the cost to have the carpets commercially cleaned.)

I would like to understand your thought processes concerning your post.

Please tell me how you are correlating an unsigned lease with whether or not you should return his initial security/pet deposit? What does one have to do with the other?

Additionally, if the carpet has only suffered normal wear and tear for the period of his tenancy, by what legal fiat are you thinking that you can charge him for commercially cleaning the carpets and charging him?

Absolutley YES it's HIS MONEY, NOT YOURS!

As long as he gave a proper 30 day notice to move you MUST return the deposit minus any legitmate deductions, and NO you cant charge him for running ads and finding a new tenant, he didnt break the lease, cause he had NONE!!!!

there wasn't any mention of "charging" him for advertising or finding a new tenant. it was simply a question regarding returning the deposit...you answered that. carpet cleaning for pet dander and wet dog smell in the house

YES you can charge for the carpet cleaning of pets, just not normal wear and tear.
