reverse discrimination in WI

What is the name of your state? WI
We now live in WI. There currently is open enrollment as I understand it in the state of WI, which is that we are able to apply to another district if we are unhappy with our current district. We are not happy with my daughter's current school that she would be mandated or zoned to attend and have applied to attend another district. However, I spoke with someone who from DPI who indicated that the home school can deny us our open enrollment request if we request open enrollment and happen to be a non-minority (we are a non-minority). I did indeed call the enrollment office and was told that as there are 43% of minority students that non-minority students are not able to leave and do not have the open enrollment available to them. I question if this is legal to discriminate on someone based on their race, even if it is that they are a non-minority even if it is under the Desegregation act? Also what would be our legal options, if any, to make sure that this discrimination does not occur and that we are able to participate in open enrollment like everyone else?
