What is the name of your state?florida
My son is in grade one. Since attending public school he has been repeatedly picked on and bullied. One episode in afterschool care where he was ganged up on by three kids .This whole year has been a waste. He has not learned anything. His classroom is 25 children one teacher. Out of the 25 students he is the only white caucasian. We have asked repeatedly from the first day of school to have him tested for a learning disability. Now it's March with nothing being done yet.I found out today that our neighbors child was tested and moved to a private school last month. she is african american. We have lived in the same house for 5 years. Her family just moved here last sumhmer. What happened to the " NO CHILD LEFT BEHIND ACT" !!! mine is being left behind. please help. VERY UPSET MOTHER

There is no such thing as "reverse discrimination." There is racial discrimination and that what it sounds like to me is happening to your kid.

Stand by for help...there are some very knowledgeable education law people on here.

Just because he is the only "white caucasion" (redundant, by the way) and his teacher is African American does not mean he is de facto discriminated against. The responsibility for him to learn is his and yours more than it is the teachers. Teachers are there to teach. Students are there to learn. Unless the teacher is refusing to teach your kid, and you can prove that she is doing it because he is "white caucasion", you have no legal basis - only an emotional response to your kid not doing as well as you think he should.

state of florida

I have to correct you . His teacher is NOT african american. I don't have a problem with his teacher. I have a problem with the school and administation. Demographically in his school it is in public record that 52% is african american, 46% is hispanic; and ONLY 4.6% is white. The teacher did have an aid ; but the school took her away. I have asked repeatedly to have my son tested for a learning disability from the beginining of sept.Nothing has been done yet. I am handicapped myself and the least person to be prejudice. MY son has been called whitey, stupid, kiss my black ass etc. this is grade one. Why should I transfer him when this should be a county school teaching interaction with all races and instilling non prejudice. He has been teased and bulllied to the point that he does not want to attend anymore and makes himself sick when we get to school grounds. I have no faith is the school system anymore. I understand why there are so many parents home schooling now; Because obviously in the school system they are not teaching. They are only preparing students for the so called FCAT.

**A: that's news to me. Tell more.
I dislike that term. It's a media made up concept, like "living will."

There is only racial discrimination, in my never to be humble opinion. To use the term "reverse discrimination" makes it sound like only the major racial group practices racial discrimination. That, of course, is not true.

**A: ok, thanks for your opinion. Now what is the legal answer?

I wouldn't have the slightest idea. Thus, my admonition:

I have also frequently made the statement, there is no such thing as reverse discrimination, on these boards. Either it's discrimination or it's not. It is just as illegal to discriminate against someone for being caucasion, or male, or English, as it is to discriminate against someone for being black, or female, or Japanese.

The discrimination laws cover ALL races, BOTH genders, ALL national origins etc. There's no need to coin a new term for discrimination against so-called majority groups.

Also on my list: "hate crime."

That makes it sound like anything but a "hate crime" is committed with love and compassion.

**A: Yes, I hate crime also.
Me too.

Especially "reverse murder" which is giving birth to someone who, it turns out later, should never have been born.

Get an attorney or talk to the board again. That is about your only options. Proving anything is going to be hard and even if you can fighting the school is hard. I understand where you are coming from for different reasons but its not going to be easy good luck.
