Reversing Grandparents Custody over Grandchildren - Can mom do that?

i am located in northern virginia. my mother and step-father have joint custody of my 5 year old niece and have since she was 2. my sister voluntarily signed up a written agreement to make this happen with lawyers present. well she has been no real part in my niece's life, at one point moving out of state without notice and not calling for over an entire year. she just recently has started wanting to see *ray* in the past 6 months or so. just this weekend, my parents recieved a letter from her stating that she is taking them to court to gain full custody of my niece. This is the thing though, the best interest of *ray* is to continue to stay with my parents. they provide an extremly stable and very condusive environment to this little girl. On the other hand, her mother can oly provide the complete opposite. my parents have obliged anytime the mother has wanted to see *ray*, only to have ray come home saying that she slept on the couch at her mommy's house. I guess my question would be is this: In this situation, what factors would be considered to change this order of joint custody if the mother voluntarily agreed to this 3 years ago and the child has lived with my parents since then? (with no support from the mother, ever) I would love to go into more detail, because there is so much more to it, but can anyone help?
