Is there a difference between a Right of way over a piece of land and a Right of way over an owners Undivided Interest in land. does the Interest or ownership give you any more rights than just a common Right of way to pass over?

If the owner of the undivided interest sells his interest, or gives it away, or whatever, then what do you have? Nothing. You want an easement that runs with the land, not with an interest in the land, because an interest can always come to an end.

Of course, an easement that runs with an interest in the land may be all that the grantor can give, so maybe you will be stuck with that.

A previous deed gives any abutter a right of way over land that is actual road , my deed is the only one that states the Undivided Interest. I did not know if this does anything for me , as I all ready have a right of way because I am al ready an abutter.
