I have a quick question, mainly for my own knowledge and interest(because the other person involved wont listen to anyone considering this B!*@&)
Here it is: I have this male friend who was with a woman for 9 years. They got married and 4months after they married, she left him for another man. She then left the state. She and her boyfriend have returned and she is now pregnant. My friend and this woman are still married. He won't file for divorce because he thinks since she left she should file. ( I know irrelevant), anyway, can the bio-dad leagally sign an affidavit of acknowledgement of paternity and be paced on the baby's birth certificate if she is still leagally married to some one else? We all told him to get the divorce underway BEFORE she got knocked up, but he didn't believe me when I told him why. I was just interested in this matter.Thanks for any answers.

Anyone can sign the acknowledgement of paternity (it's called lying) but the courts view the husband as the legal father of that child until such time as it is proven not to be.

It's just another expensive, stupid lesson that will have to be fought out in court. Tell this idiot is he doesn't file for divorce now he'll get what he deserves, including (perhaps) child support payments for a child that is not his.

Well your on the right site, but it's probably not were you want to go for advice. Mostly everyone here is bitter as %$#@...

I would suggest he gets an attorney.
