my lawyers sent me an authorization for disclosure of all my past medical records for the other lawyers. It states in this agreement that I have a right to revoke this. When I told my lawyer I wanted to do this she told me I need to sign so they can't call my doctors from the past. I know they can't anyway with out my authorization. If I sign it they will use it against me because I had problems in the past but nothing like I do now! It is worse. Do I have the right to revoke past medical records? Has anyone had this problem? I feel my lawyer is not looking out for my best interest plus they never got any information -discovery of the driver that hit me such as log books past driving record and GPS, drug test or interrogatories. I was told they are not going to go after the information because they don't want to be aggressive. I have given them everything until this. I don't know what to do. Do I try to hire a new lawyer.
 


You have the right to revoke authorization, and you must do so in writing. This should be stated clearly in the original authorization to disclose records according to HIPAA 2003. However, keep in mind that what may previously have been released to a third party is not protected.

I agree with Job_hunting!

However....consider this. If you revoke the authorization of past medical records....this WILL NOT look good for you in the overall outcome. It WILL be looked at as though you are hiding something.

Be open and honest.

Those who hide nothing....have nothing to hide. :)

The truth will be found out in the end and probably NOT IN YOUR FAVOR due to your unwillingness to cooperate.
