What is the name of your state? California

I gave my landlord 30 days notice in writing that I was moving out October 1st and I did move out on time. He has not returned any phone calls or my letter regarding my deposit. What rights do I have to find out what he is doing regarding my deposit - am I getting it all back or is he charging me for something or what?

**A: your rights are as stated in the L/T law so read the CA Civil Code and it's there in black and white.

Did you provide your new address and phone number for contacting you? You are supposed to receive either your deposit or part of your deposit plus an explanation of charges within twenty-one days of the end of your tenancy. If anything major needed repairs that you would be responsible for, you should have been informed and told of approximate cost, and received a partial refund (if any) of your deposit within twenty-one days, with the promise of final bills after the work was done. You've already done the first step, which is to send a demand in writing. You now have the option of suing for your deposit through Small Claims Court.

Did you give you notice as perscribed in your rent lease contract (some contract requires certify mail). Did you pay your full rent for October on time in October? If just gave you 30 notice on October 1, 2005 and did not pay your last months rent. Maybe your deposit would not even cover last months rent plus late fees (for not paying october on time), and damages to the apartment. But still you should get a notice of the deductions.
