i live in Ca. about 400 miles from my father. I am his POA. The problem i have is(Besides The Distance thing), is that he has had to enter a Rehab facility after an accident. He was fully independent prior to this, but now he will have to have , at a minimum, full time in-home care(He wants to go back to his house, instead of moving in with my family). My wife has worked in Health care for 20+ years, and could take care of him.

What rights do i have, if i see that he would be better off staying with us, vs. having a stranger come in to take care of him 24/7?

And what rights does he have? He has enought $$ to have in home care for a couple of years, but after that, he would have to move in with me to continue care.

A POA doesn't have any "rights", they have duties and powers.

Unless he has been conserved, he has all the rights any of us do.

If he is competent to make decisions, then he gets to make the decision. It's his money he'd be spending, after all.
