My husband and I have put our home on the market and have found a house that we are interested in.

Problem - A couple are already under contract to purchase this home (or maybe not..)

They are supposed to be closing by month end however there is no mortgage commitment. We have been told that the mortgage commitment was to be had by 2/23/02 but because no one acknowledged that the time had expired we were told another 30 days was automatically added. Firstly, is that true? Secondly, can the seller back out without any legal ramifications in order to sell the home to us as we have been told by our mortgage broker that we could be closed in 35 days after contracts are signed and we are willing to pay the asking price for the home.

We have been moving full speed ahead as if we were the purchasers. We have provided our broker with all of the necessary info and are ready to go. Does the selller have any obligation to those buyers that are having difficulty getting a mortgage commitment and having problems with the idea of coming out of pocket for the replacement of a heating unit that will cost between $1000 and $1700?

Your help would be greatly appreciated because we are beginning to tire from this emotional rollercoaster ride that we are on. It's been on again - off again.... Thank you.:confused:

I think that is where the problem might lie... Our realtor is everybodies realtor. Seller's, original buyer's and ours......:( :(

:confused: What could an attorney do for us at this point? We are not bound by any type of agreement - just seem to be going thru the motions at this point - We are just being considered "back-up buyers". In the event the deal should fall thru- here we are.... I just wanted to know if the seller had an out.

Are you saying that the seller should seek legal advice?:
