My son was in a accident which was his fault he fell asleep at the wheel and hit another car. When he got out of his vehicle he asked the lady if she was alright and she said yes. The passenger that was a man was across the street calling the cops and he asked if he was okay and was he calling the cops she said yes.

My son called me on his cell phone to let me know he was in an accident, he got to tell me where and that he fell asleep at the wheel. In the background I heard someone hollering and then I lost signal with my son. I tryed for about 5 minutes to call him back, when I did finally get ahold of him he said can you please get here know I just got my butt kicked.

The passenger told him he better get back into his truck and lock the doors or he was going to kill him, well my son was like I don't have to get back into my truck. The guy came over and headbutted then had him on the ground kicking him in the head and the neck. The guys buddy that I am assuming they called had to pull him off of my son.

They took my son to the hospital to be checked out. Now mind you he was not hurt from the accident, his injurys came from this guy beating him up. The sherriff asked my son if he wanted to press charges and he said yes.
They handcuffed the guy and took him to jail. The sheriff came to our house the next day and said since there was injurys and they couldn't get a written statement from my son they did not book this guy. He needed my son to fill out a statement and then they would put out a warrent for his arrest.

I guess my question is what do I need to do?????
 


Well you owe for the damage to the other car but the criminal part of your son being assaulted needs to go to court.

Get an atty and press criminal charges against the passenger.

Depends. How old is your son?? If he 18 or older... there is nothing YOU can do except help him to handle this.
1) Accident: He needs to contact his insurance company and let them know of the accident.
2) Assualt: He needs to go to the police and file a criminal complaint.
