roof damage and interior damage

What is the name of your state? colorado
I live in colorado and last year we had a flat roof that leaked and needed to be replaced or repaired. We contacted our insurance company and the denied our claim because we did not maintain the roof over the years we didnt own the house. We purchased it 3 years ago and the company did what they call a drive by inspection . They put no rider in the policy and they charge us for the structure as if there is no problem but when it came to the repair they said sorry but the roof has had prexisting damage. My questions are do we have a case against them for not covering the roof which we paid for out of pocket and do we have a right to file for the damage inside the house because of the leaking roof?
can anyone help out ?

No. Apparently, your roof leaked because of wear and tear and it was not properly maintained. Homeowner's insurance does not cover that. MAYBE a home warranty policy would have. In order for homeowner's insurance to cover the damage a "covered event" must have occurred. Covered events are things like: lightning struck the roof and damaged it, a tree fell on it, a fire, etc.

I was told that but be have had hail damage over the years and the inside of the house was damaged from this condition . would that be covered at all. I have called the insurance out to file a claim and will meet them on thursday.

How do you file a claim for hail damage, but you don't know when the hail damage occurred? Apparently, they aren't finding evidence of direct "damage" to your roof. The damage would appear to be from something striking the roof, instead, your damage is from wear and tear.
