I met a girl who I let move in April 1st this year. We had no written agreements only verbal. I rented one room of my house for $650 a month all utilites included. We agreed that she would pay $325 on the 1st and the 15th of each month. I rent my house from my landlord and I did not tell them about this. The problems began right away. I am too trusting of a person. She moved her stuff in and said she had the money but only gave me $200 of the $325 she owed me. Well this went on and on. She was never paid in full and was alway weeks late. Excuse after excuse. I would get $40 here, $100 there, when ever she felt like it. She broke my bathroom toilet, (promising to get a plumber and let it broken and disqusting), ate my food, and was a slob, just to name a few things. She had a job when she moved in so I wasn't worried about the money. She quit it right away and was home all day long when I originally thought she would be home only at night. After 2 full months of her not paying on time, I had treatened over and over that she would have to leave. Finally she owed me $670 and she had no job for the past almost two months. I knew she could not pay so I asked her to leave. I asked her a week and a half before she left. She left all her belonging in the room and left it a mess. Before she left I asked her to sign a letter stating that she had 30 days to pay the $670 in full. She signed it and said she would get her stuff out in a few days. She told me she would give me some of the money before the month was up. I kept asking her to get her stuff and I kept getting excuses because she has nowhere to put it. She came and got her truck that had been sitting in the driveway for weeks and was sneeky about it and didn't come to the door to get any stuff or pay me any of the promised money , although the 30 day is not up, she did verbally agree to pay me something. I called her on Wends. and told her to get her stuff out by Fri or it would be outside. She called me treatening to take me to court because she says anyone who had established residency, meaning she got mail there, had to have 30 day to get her stuff out. My question is doesn't the 30 day thing mean if she stayed and her stuff stayed she would have to pay another month in rent. It doesn't mean you move out and leave your stuff for 30 days and pay no rent on it. If the rent stops being charged the room should be cleaned out. Right? I have no way to find her after she gets her stuff to get my money on the 30th. I don't know where she lives, her birthday, liscense number, parents address, refrences, nothing. She could simply vanish and I would not get my $670. Which I will probably never see because she still has no job. Can I keep her stuff until the 30th for calateral until she pays me in full? Does she have a right to leave her stuff without paying rent. Keep in mind for 2 months she was always atleast a month behind in rent and late, I warned her for well over 30 days. What are my rights and what should I do? I would really appreciate an answer and any help you could offer.
Things are getting really ugly and I have a two year old daughter. I am worried this girl is a thug and will bring a bunch of guys over to intimidate me. Help!
