Last spring myself and six others signed a lease to rent a house for the months of 9/00 through 5/01. We found out a few days before we were due to move in that one of us would not be coming back to school. This was his own decision. He was not forced or unable to return. We are all cotenants on one lease and are therefore responsible for a total amount per month. We also had an agreement between ourselves and the landlord as to how much each person was to pay per month. Brian, the person who moved out, paid the first month's rent. He told us that he would find someone to take his place or continue to pay rent until he did. When October's rent came due, he told us that he would send the money in the mail. In the meantime I paid his rent to cover him to the landlord. No money ever came in the mail and we have neither talked to him or seen him since. His rent for November went unpaid until December when the landlord came looking for it. I again paid to cover him for the month. We instructed the landlord to take his rent for December out of his security deposit. He has not returned any of our calls and we recently sent a letter to his house asking him to contact us. We have also posted flyers around campus looking for another roomate. My question is what to do in order to recover the two month's rent that I paid in order to cover him and what to do about the rest of the month's rent. Was he obligated to pay the rent or at least find someone else? I feel that he should of at least notified us of his intentions not to pay us. What can we do?
