Hi,
I live in the state of Oregon. I need some legal advice on how I can get my adult daughter to move out of my house. I rent an apartment, and she is not on the rental agreement. She simply refuses to move out. Do I evict her? And if so, how do I go about doing this?

Does she have any legal rights to my apartment?

Any advice would be greatly appreciated. Thanks,

From your post, it sounds like she doesn't have any rights to tenancy (as long as she is an adult and not on the lease). If correct, then you can simply call the police and ask them to give her a trespass warrant. If she returns, you can have her arrested.

Further, if she has no rights to tenancy, you could simply wait until she is out, pack her things and leave them where she can get to them (this does NOT mean throw them in the street, you are responsible for them until she takes possession). And while she is out, get the locks changed.

Roommate Problem

I have the same problem in New York. Does the advise hold true for New York. The police discouraged changing the locks but I'm not sure if that because they don't want to deal with a potential domestic dispute.
