Problem 1
Basically, my roommate owes me for the last 3 months of utilties, as we split the utility bill between the two of us for our 2 bedroom apartment. Does the fact that he paid half of the utilities for the prior 9 months set a precedence to which a judge might see?
This has amounted to 160 dollars of unpaid utilities for his half. Everytime I talked with him about it, including the day he moved out, (our lease ends 7/31/2006) he agreed to pay me for the unpaid utilties.
Every attempt I have made to contact him since he went back home has not been returned, he has now gone on vacation with his parents and I am unsure when he will be back in town. I have all the bills and several witnesses to him saying he will pay me.
Can/Should I take him to small claims court to get this money?
Problem 2
Before he moved out, he made several significant damages to our apartment. He punched several holes in his bedroom walls, broke his bedroom door, and his father put a large hole in a wall the day of their move. This amounts to $306 dollars in damages via the pre-move out inspection done by the leasor. He agreed to pay for all his damages, yet has not contacted our apartment complex, sent a check, and all calls to his parent's house have gone unreturned.
Our security deposit was only 100 dollars each, thus leaving a $106 dollar balance. The apartment complex knows all damages were done by him and it has been noted on our inspection that it was to his bedroom, yet they will still keep my security deposit.
Can I take him to small claims court to get my security deposit back from his damages?
