I am leasing an apartment in San Diego, California. Both my name and my roommates name appear on the lease. I find myself in the unfortunate situation of having roommate difficulty. I am wondering what my rights are in this situation. Is a boyfriend, who is not on the lease, allowed to spend the night numerous nights a week, or do I have a legal right to limit this. Is there any way I could break a lease on the basis of being in an "un-livable" living situation, or is that wishful thinking?

I am in a similar situation and am wondering if you have heard any updates on your situation.

I am living in San Francisco and live with 4 other roommates one of which is on the lease with me. The other 3 roommates have been paying rent but haven't signed anything.

The roommate on the lease with me has been complaining about the clenliness of the apartment since we started ~3 months ago. She came up to me one day and told me that she wanted one of the other roommates to leave. I told her that I didn't think it was fair to boot him for that reason and she threatened to take me to court.

I've been searching online for some law on subtenants but have yet to find anything substancial. I've talked with a housing rights committee over the phone and they told me that she alone would be unable to kick out the other roommate unless I agreed.
