Recently my old roommate and I parted ways. When we moved in together we split the $350 deposit on the apartment ($150 was non-refundable). The day we were to move in to the apartment the complex called and told me that I would have to put an extra $350 down on the apartment since my credit rating was poor. I put the entire second deposit dowm on my own since it was my problem. I recieved the check back when we moved out. I split the remainder of the first deposit (there were some repair charges to the apartment taken out) and sent my old roommate the check for her half. She had already contacted the apartment complex to see what we would be getting back. Now she is threatening to take me to small claims court because she wants half of the second deposit as well. I reminded her that I paid the second deposit and if she thought she paid half to send me the cancelled check and I would send her her share. If she does take me to court, is she entitled to half of that deposit even if she didn't pay it?

Based purely on the information in your post, it doesn't sound like the 'ex-roomate' would be entitled to any of the deposit that she did not contribute.
