I moved here in 1999 injured from a back injury and not working and moved into my girl friends home. The house is in her name and she has when we argue she says it’s her house and I am just paying rent. I give her my entire paycheck in a joint account that we have and I also include my child support to pay for bills. She has said that it is her house and has threatened to kick me out. Now we have gotten into another argument and I said I was leaving she says I owe her for home equity loans she took out on the house. I offered to pay her half of the credit card that has both our names on it and half of the bank account which has an overdraft in it. She said that I was screwing her and that she was going to take me to court for $40,000 the cost of the loans she said she took out to pay bills that were mostly mine from moving there. Can she do this? Even though she can say get out right now and call the police and have me removed from the house at that moment and has threatened to do so? When she sells the house I don’t receive anything from it all of that will go to her even though she wants me to pay the equity loans on the house she took out. Please help.

*** Do you mean take you to court?? The answer is yes. If she wants to spend the money it would take to pursue this case against you, she can. Is the likely to win?? Based on your post, no.

*** She can't do that. At this point, you are a 'tenant' and as such, if she wants you out, she will have to follow the legal process of eviction.
