My car was hit by a van may 23,2000. Ive filed a claim with thier insurance at that time because the police report faulted the van driver.the van is owned by a business that provides transportation for the elderly and disabled and i was expecting the process to be pretty quick. well it wasnt. it took me a months worth of calls to get thier insurance co. name (a false name was given on the police report and i was refused the information when i contacted the transportation co.) thus far its been 3 months and 3 repair estimates and today i phoned their insurer and was told that thier insured(transportation co.) has to pay them $1,000.00 because he doesnt have enough coverage and until he pays they cant cut me a check for repairs to my car. can i take the transportation co. to small claims court even if i havent gotten any repairs done to my car. its been 3 months already and the last estimate stated that their could be impending damage to my car because of how hard it was hit......at this point i dont know what to do.....

go to small claims court - you have the right to recovery, even if you don't get your car fixed (you still suffered the damage)
