I work for a company in Arkansas, my question is:

My employer claims that we are salary based, and that is what it shows on our paycheck. We are given vacation days and sick leave, and we also get comp time if we work more than 80 hours in 2 weeks (we are paid every 2 weeks).

If we miss a day, or miss part of a day, that time is taken out of our sick leave or vacation days, if we have none left, our pay is docked, I am just wondering if this is legal?

Thank you.

Regardless of whether you are exempt, or salaried non-exempt, it IS legal to require you to use paid leave of whatever form to cover absences of any length.

If you are exempt, it is illegal to dock your pay in partial day increments (once you run out of leave) unless FMLA is involved. It is, however, legal to provide you with comp time in lieu of overtime.

If you are non-exempt, it is legal to dock your pay for any time you do not work, even if you have run out of paid leave. However, in that case it is illegal to provide comp time in lieu of overtime.
