My sister was recently in an automobile accident in Santa Monica, California. The other driver was at fault 100% due to a traffic violation. My sister's car was totalled by the insurance company because it's a 1990 model and was not worth repairing. Both parties in the accident have the same insurance company. They are only willing to give her $2000 for the loss of her car and pay her medical expenses. She contacted an attorney and was told there was nothing she could due to pursue any damages. What can she do???:confused:

My response:

What kind of damages was she thinking of pursuing? Was she injured ? Did she seek medical treatments ? When was the first time she sought medical treatment ? What does your sister's adjuster say concerning the property damage valuation ? What is your sister's deductible ?

What was the exact date of the accident? Was a lawsuit filed ?

What was the attorney's explanation ?

I need answers to these questions (don't skip any), and then we may have a basis for further discussion.
