Hello,
I had recently purchased a Nintendo Wii via paypal that a seller listed on craigslist. I filed a dispute on paypal once I discovered that my item was not shipped. Paypal contacted the seller and he claimed he would issue a refund. Well now paypal sent me an email stating that there were no available funds to issue a refund from the seller and I have to contact them on my own to retreive the refund. I have sent numerous emails to this company with out a response.The seller has an internet company out of Cedar Rapids IA. How do I preceed to take legal action in this situation?

You will have to file a lawsuit in his home town.

However, if you paid via a credit card (through PayPal), you can dispute the payment with your card company.

Paypal hoops!

Someone as refund some money for me on my Paypal account, but for some reason it took 2 months for me to get my money!:confused:

Hopeless unless you're a millionaire.

I can tell you right now that trying to get money back from PayPal is very hard if not impossible unless you're a millionaire and can afford great lawyers. Their policy's pretty much prevent any loss on their part.

Did you pay using paypal via credit card or bank? Paypal's logic is to have a complaint or meditation center and they will say who is right. This is stupid because the other party would deposit the amount in to their account making their paypal account zero.

Hopefully you paid via credit card. Contact your credit card company and request a CHARGEBACK, a reverse charge. Usually, you might have to fax some information to them. When paypal gets this they are screwed and you will receive a credit for that amount.

This is what I do with deadbeat ebay sellers. I had to do this about 4 times dealing with deadbeat ebay sellers since 2002 and chase never gave me a problem. Reverse charge as little as 1 day. I only had to fax info to them once. While worthless, I would fax the paypal claim to them as well.

Paypal is pure evil, I only use them due to convenience and lack of other options. Whenever you pay use via credit card and not bank. With bank it's more difficult to fight it.

Speaking out of personal experience, nothing more.

PS their is a NEW DS version in 2009. Smaller with cameras. No backward compatiblity with pre ds games. either wait for a price drop of the current model or save up for the new one. Your call.
