scammed by a roofer

I'll try to make this long and disturbing history as short as possible. I had my roof repaired in 2003 and every since then I've had nothing but problems. Shingles are constantly falling off and I've had rain damage in the living room and dining room(that my husband and I took care of). I was doing dishes and noticed that there was water now coming through in the kitchen. I thought enough of trying to deal with him and took the chance with my homeowners insurance again. Well the inspector was here and told me that they would not pay for it because it was shotty workmanship. So I have no choice but to deal with the roofer some more. I'm told this weekend, by wednesday, by friday it will be done because of course they didn't show up for any of the times promised. The owner of the company doesn't even take my calls anymore, I just got off the phone with his assistant who tells me that he just talked to me today and thought everything was fine, I never talked to him today. He'll call me by 9am tmo. (I'm not holding my breath) My fear is this, the inspector told me that I need to have it tarped asap and I told the roofer that. I guess at this point, I should just tarp it and keep the receipt but what can I do to him? When do I say enough is enough with the phone calls and empty promises? Can I ask him for his insurance companies name? Is that a possible route? I have a 5 year warranty and it's been less than 2 years. Any advice would be greatly appreciated.

It is a possible route. I would send a CRRR letter stating what needs to be done. I would go ahead and tarp and charge him with the cost. I would also let him know you are taking him to court if it's not satisfied in ?30? days. You can sue him.

Is the roofer licensed and bonded? Or did you go with someone that offered a great deal?
