I am a custodial father who is denying visitation to the mother. Believe me I want my childrent to have a realtionship with their mom, however I do not want them in unknown or unsafe places. The last time they were with her she got in a fight with her boyfriend in front of the kids and I had to go pick them up myself at 1am. She calls only when I am at work, not when the kids are with me in the evenings. My daughter wants to see her mom, however she is afraid to leave with her. She has threatened me several times (as a guy hard to admit) and the law just says they can do nothing and basiclally laughs at the situation. She is a ICE addict and indegent. She called yesterday and I asked her where they would stay and she said she did not know. She has not provided any information to the courts or CPS when asked. The officer who came out yesterday said she filed a "interference with visitation thing?" My lawyer keeps saying to not give them to her if I feel it is unsafe, however I do not want to be in contempt. He is a "sit-in" judge but I still get worried. Am I doing the right thing? Can I go to jail for this?

A lot depends on what your order actually says and what sort of proof you have of her being less than fit. I'd also ask your lawyer if he thinks it would be worth filing for supervised visitation.

Her visitation times are: 2nd, 4th and 5th weekend, beginning after school an friday and ending beginning of school on monday. She has not picked them up once. The court order also states it must be a "safe, secure, non-violent enviroment" and she does not have a home. She does not even (or saysshe doesnt) have a residence. I think she does it so we cannot serve her court papers. We are trying to get her to court, but in the state of texas you cannot go to court unless the other person is served. She only comes to get them (attemps) when she can get a ride. However, if she is supposed to get them after school and she does not try to show up till after 7 or 8, isnt there something wrong with that too? CPS came in and wrote an evaluation plan stating she could only see them with me, but I hear that is bacisally a piece of paper. I make to much to get help, she does not pay Child Support and she hides her name and number everytime she calls. She knows how to work the sysytem, and it is scary.
